Dispute Resolution

Early and clear strategic advice is key to achieving the best outcomes

We advise on a wide range of disputes for companies and individuals, and we are regularly instructed by both claimants and defendants.

Property disputes

• Boundary, nuisance, rights of light and neighbour harassment disputes

• Landlord and tenant (both commercial and residential), including possession proceedings, and     covenant breaches

• Disputes between leaseholders in the same building

• Negligence/breach of contract claims against managing agents

Private Client and probate disputes

• Challenges to Wills arising from allegations such as undue influence, lack of testamentary capacity, breach of promises to inherit

• 1975 Inheritance Act proceedings for reasonable provision for family and dependants

• 1925 Administration of Estates Act challenges and applications

• Lasting Powers of Attorney (LPAs) – advice on duties and powers, challenges to LPAs; Court of   Protection applications

Commercial litigation

• Contract disputes

• Supply of goods and services claims

• Partnership, LLP member and shareholder disputes

• Professional negligence disputes

• Challenges to solicitors’ costs

• Data Protection breaches

• Defamation and Privacy claims (both to prospective claimants and defendants)

Where court or tribunal proceedings have not yet started, we can assist at a pre-action stage to achieve, where possible, an out-of-court settlement through strong and effective pre-action “open” correspondence, in “without prejudice” negotiations, representing your interests at a mediation, or some mix of these approaches.

Where proceedings have begun, we assist you with clear analysis at an early stage of the merits, and risks, of pursuing or defending a claim, and clear advice on the costs of doing so. We have experience of working with the best sets of Chambers at the Bar and, where necessary or advisable, can advise you on choosing the right barrister to represent your interests in the litigation and, in particular, at court or tribunal hearings.
