The consequence of not having a Will can be difficult for loved ones to deal with. Making a Will allows you to choose the people who will administer your estate and to determine in advance who will get what property. Doing so sooner rather than later in life minimises the risk of the Will being challenged on the ground of lack of capacity to make a Will.
Making, and registering with the Office of the Public Guardian, Lasting Powers of Attorney for both “Property and Financial Affairs” and “Health and Welfare” allows you to express wishes, and even give instructions, about how your finances and personal welfare should be managed when you have lost capacity.
A “Property and Financial Affairs” lasting power of attorney can also be used, with your consent, by your chosen attorney to do things that it is inconvenient for you to do yourself (e.g., during absence abroad), even though you have full capacity.
